VILLAGE CASTING, INC. Terms of Use Agreement This Agreement is effective as of February 2013. Introduction Welcome to www.hollywoodgamenightcasting.com, owned or licensed and controlled by Village Casting, Inc. (“Village Casting”, “we”, “our” or “us”). This page explains the terms by which you may use Village Casting’s website and service. By accessing or using the Village Casting services or website and software (if any) provided through or in connection with the website, you signify that you have read, understood, and agree to be bound by this Terms of Use Agreement (“Agreement”). You are solely responsible for the activity that occurs on your account, and you agree to keep your user ID and account password confidential and secure at all times. You must notify Village Casting immediately of any breach of security or unauthorized use of your account. Although Village Casting will not be liable for your losses caused by any unauthorized use of your account or loss of your user ID or password, you shall be liable for the losses of Village Casting or others due to such unauthorized use. Where available, you may use your account settings (“Account Settings”) to control your member profile (“Member Profile”). By providing Village Casting o your email address, you consent to Village Casting using the email address to send you feature-related notices, including any notices required by law, in lieu of communication by postal mail. You may not opt out of these e-mails. Village Casting may also use your email address to send you other messages, including changes to features of the website and special offers, and with your consent, Village Casting may provide your email address to third parties for direct marketing purposes. You agree not to use or launch any automated system, including without limitation, “robots,” “spiders,” “offline readers,” etc., that accesses the website in a manner that sends more request messages to the Village Casting servers than a human can reasonably produce in the same period of time by using a conventional on-line web browser. Intellectual Property For the purposes of this Agreement, “Intellectual Property Rights” means all patent rights, copyright rights, mask work rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights and other intellectual property rights as may now exist or hereafter come into existence, and all applications therefore and registrations, renewals and extensions thereof, under the laws of any state, country, territory or other jurisdiction. If you are a resident in a jurisdiction which recognizes moral rights in certain works, to the extent permitted by law of that jurisdiction, you agree to waive your moral rights in any Casting Content (as defined below) submitted via the website. All Intellectual Property Rights in the website and all material or content made available by Village Casting by means of the website remains at all times the property of Village Casting or the property of Village Casting’s licensors. Any names, images and logos identifying Village Casting, Village Casting’s partners or third parties, including, without limitation, Village Casting’s distributors and brand sponsors, and Village Casting’s or their products and services available through the website are proprietary marks and may not be reproduced or otherwise used without express, written permission. Nothing contained in this Agreement shall be construed as a grant of any license from Village Casting or any conveyance, assignment or transfer of any right to use any trademark, patent, design right or copyright or other intellectual property right belonging to Village Casting or to any third party. Third Party Content and Software Where content, information, software, advertising and any other material or services are supplied by third parties, you acknowledge and agree that Village Casting may not control and may not purport to endorse such content, software or services in any way. All third party content, software or services that are made available through Village Casting’s website are offered in good faith but Village Casting does not (to the extent permitted by applicable law) accept any responsibility for the accuracy, reliability, timeliness, or otherwise of such content, software, advertising or other material or services or for the use, download and/or installation of such content, software, advertising or other material or services. Unsolicited Submissions Village Casting does not accept or consider unsolicited creative materials, ideas or suggestions either via the website, email or any other means whatsoever. Casting The website may allow Users to participate in the casting process for third party content providers’ programming and the website and/or third party software may collect video and audio-visual content and/or other information associated with casting of any and all media programming (“Casting Content”). However, the fact that Users may submit Casting Content does not guarantee that they will be considered by Village Casting or that they will appear on a third party content provider’s program. Village Casting also has the right, but not the obligation, to use your username (and real name, image, likeness or other identifying information, if provided in connection with Casting Content), city and state in connection with broadcast, print, online or other use or publication of your Casting Content. You are solely responsible for your Casting Content that you upload, publish, display, link to or otherwise make available (hereinafter, “send”) to Village Casting. You agree not to send any Casting Content that: (i) may create a risk of harm, loss, physical or mental injury, emotional distress, death, disability, disfigurement, or physical or mental illness to you, or to any other person; (ii) may create a risk of any other loss or damage to any person or entity or property; (iii) may constitute or contribute to a crime or tort, including Casting Content that is libelous, defamatory, obscene, abusive, pornographic, threatening, an invasion of privacy, or an infringement of the intellectual property rights, including, but not limited to, copyrights and trademarks, of any person or entity; (iv) contains any information or content that Village Casting deems to be unlawful, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous or threatening; (v) contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships; (vi) contains an advertisement or solicitation of funds, goods or services; (vii) contains any information or content that you know is not correct and current. You agree that any Casting Content that you send does not and will not violate third-party rights of any kind, including without limitation any Intellectual Property Rights, rights of publicity and privacy. Village Casting reserves the right, but is not obligated, to reject, remove, edit or reuse any Casting Content that Village Casting believes, in its sole discretion, violates these provisions. Village Casting takes no responsibility and assumes no liability for any Casting Content that you or any other Users or third parties send. Village Casting has no control over whether such Casting Content is of a nature that may be unacceptable and, accordingly, Village Casting expressly disclaims any responsibility for Casting Content. You understand and agree that any loss or damage of any kind that occurs as a result of the use of any Casting Content that you send, upload, download, stream, post, transmit, display, or otherwise make available to Village Casting, is solely your responsibility. Village Casting is not responsible for Village Casting’s display, use, misuse or loss of your Casting Content. You understand and acknowledge that Village Casting’s use of any Casting Content may be inaccurate, infringing, offensive, indecent, or objectionable, and you agree that neither Village Casting nor any of its affiliates or third party content providers shall be liable for any damages you, or anybody else, alleges to incur or actually incurs as a result of such Casting Content. Further, Users agree to hold free and clear of any liability and fully release Village Casting, its affiliates and third party content providers using such Casting Content from any and all claims of slander, libel, right of privacy, and right of publicity. Video Chat From time to time Village Casting, for casting purposes or otherwise, may make available the opportunity for certain users to participate in Video Chat. If you use this Video Chat function, you agree that any and all recordings (including, sound recordings) may be used for broadcast on the website or through any other form of media that Village Casting may determine in Village Casting’s sole discretion including, without limitation, for exhibition in and in connection with any third party content providers’ programming. To be considered for Video Chat, you must submit all the required information to Village Casting prior to the deadline. Not all users will be offered an opportunity to participate in Video Chat. If you are chosen as a potential Video Chat participant, you will be contacted by an individual associated with the website. For the avoidance of doubt, when you submit Casting Content through the website or third party software, you acknowledge that third parties, with the permission of Village Casting, may use the Casting Content as described herein. Subject to the terms and conditions of this Agreement, you are hereby granted a non-exclusive, limited, personal license to use the website and any third party software that Village Casting makes available to you. Village Casting reserves all rights not expressly granted herein in and to the website and the Village Casting Content (as defined below). Village Casting may terminate this license at any time for any reason or no reason, without any liability of any nature whatsoever to you. Village Casting has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites, YouTube channels or services. If you access a third party website or YouTube channel from Village Casting, you do so at your own risk, and you understand that this Agreement and Village Casting’s Privacy Policy do not apply to your use of such sites. You expressly relieve Village Casting from any and all liability arising from your use of any third-party website, YouTube channel or services or third party owned content. Village Casting encourages you to be aware of when you leave the website, and to read the terms and conditions and privacy policy of any third-party website, YouTube channel or service that you visit. Remedies. In no event may you terminate the rights granted hereunder, and you agree that you shall not be entitled to obtain injunctive relief or other equitable relief with respect to the rights granted hereunder. Assignment. You acknowledge and agree that Village Casting shall be free to sell, assign, license, mortgage, encumber or otherwise transfer this Agreement and/or any or all of its rights hereunder, and/or to delegate any or all of its duties hereunder at any time and from time to time to any person or entity. You are not permitted to assign any of the rights granted hereunder or delegate any obligations hereunder to any person or entity. Governing Law. This Agreement shall be governed by, construed and enforced in accordance with the laws of the State of California, as it is applied to agreements entered into and to be performed entirely within such State, excluding only its conflict of law provisions. Any action you, any third party or Village Casting bring to enforce this agreement or, in connection with, any matters related to this site shall be brought only in either the state or federal Courts located in the State of California, and you expressly consent to the jurisdiction of said courts, waiving any jurisdictional venue or inconvenient forum objections to such courts. Arbitration. For any claim under this Agreement where the total amount of the award sought is less than $10,000, the party requesting relief may elect to resolve the dispute through binding non-appearance-based arbitration. The party electing such arbitration shall initiate the arbitration through an established alternative dispute resolution (“ADR”) provider mutually agreed upon by the parties. To manage our services. We internally use your information, including certain application form data, for the following limited purposes: To monitor and improve our services and features. We internally perform statistical and other analysis on information we collect (including usage data, device data, referral data, and information from page tags) to analyze and measure user behavior and trends, to understand how people use our services, and to monitor, troubleshoot and improve our services. However, we do not use the non-public content of application forms (i.e. the content of questions and responses that you have not publicly shared) for these purposes. To assist the enforcement of our Terms of Use. To prevent potentially illegal activities. To screen for undesirable or abusive activity. For example, we have automated systems that screen content for phishing activities, spam, and fraud. To create new services, features or content (public data and metadata only). We may use public application form data and anonymized application form metadata (that is, data about the characteristics of a application form but not its non-public content), to create and provide new services, features or content. For example, we may look at statistics like response rates, question and answer word counts, and the average number of questions in a application form and publish interesting observations about these for informational or marketing purposes. When we do this, neither individual application form creators nor application form respondents will be identified or identifiable unless we have obtained their permission. To contact you about your service or account. We occasionally send you communications of a transactional nature (e.g. service-related announcements, billing-related matters, changes to our services or policies, a welcome email when you first register). You can't opt out of these communications since they are required to provide our services to you. To contact you for marketing purposes (if you opt in). We will only do this if you have given us your express permission to contact you for this purpose. For example, during the account registration process we will ask for your permission to use your information to contact you for promotional purposes. You may opt out of these communications at any time by clicking on the "unsubscribe" link in them, or changing the relevant setting on your account page . To respond to legal requests and prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond. 3. With whom do we share or disclose your information? We don't sell your application form data! When might we disclose your application form data to third parties? Only for a limited number of reasons. Mostly commonly, we share your information with our service providers who help us to provide our services to you. We contractually bind these service providers to keep your information confidential and to use it only for the purpose of providing their services to us. For example, we use payment processors who help us to process credit card transactions. By using our services, you authorize Casting Crane to sub-contract in this manner on your behalf. Rare circumstances include when we need to share information if required by law, or in a corporate restructuring or acquisition context (see below for more details). Sharing your application forms with the public. By default, your application forms are private. You are able to control who can take your application form by changing your casting call settings. For example, application forms can be made completely public (and indexable by search engines), private (viewable only by your company's users), or archived. We recognize that you have entrusted us with safeguarding the privacy of your information. Because that trust is very important to us, the only time we will disclose or share your personal information or application form data with a third party is when we have done one of three things, in accordance with applicable law: (a) given you notice, such as in this privacy policy; (b) obtained your express consent, such as through an opt-in checkbox; or (c) anonymized the information so that individuals cannot be identified by it. Where required by law, we will obtain your express consent prior to disclosing or sharing any personal information. We may disclose: Your information to our service providers. What are your rights to your information? You can: Update your account details. You can update your registration and other account information on your account page . Information is updated immediately. Download/backup your application form data. We provide you with the ability to export, share and publish your application form data. This allows you to create your own backups. Delete your application form data. Deleting application form data will not permanently delete application form data immediately. As long as you maintain an account with us, we retain your deleted data in case you delete something by accident and need to restore it (which you can request by contacting customer support). To the extent permitted by law, we will permanently delete your data if you request to cancel your account. Cancel your account. To cancel and delete your account, please contact customer support . Deleting your account will cause all the application form data in the account to be permanently deleted, as permitted by law, and will disable your access to any other services that require a Casting Crane account. We will respond to any such request, and any appropriate request to access, correct, update or delete your personal information within the time period specified by law (if applicable) or without excessive delay. We will promptly fulfill requests to delete personal data unless the request is not technically feasible or such data is required to be retained by law (in which case we will block access to such data, if required by law). For how long do we retain your data? We generally retain your data for as long as you have an account with us, or to comply with our legal obligations, resolve disputes, or enforce our agreements. Data that is deleted from our servers may remain as residual copies on offsite backup media for up to approximately 12 months afterward. 5. These are listed below. The sections afterward describe what we do with this information. Information we collect directly from you Application form responses. We collect and store the application form responses that you submit. The application form creator is responsible for this data and manages it. A application form may ask you to provide personal information or data. If you have any questions about a application form you are taking, please contact the application form creator directly as Casting Crane is not responsible for the content of that application form. The application form creator is usually the same person that invited you to take the application form and sometimes they have their own privacy policy. Are your application form responses anonymous? You will need to ask the application form creator this as it depends on how they have chosen to configure their application form. We provide instructions on how an application form creator can ensure they collect responses anonymously. However, even if an application form creator has followed those steps, specific questions in the application form may still ask you for your personal information or data that could be used to identify you. Information we collect about you from other sources Usage data. We collect usage data about you whenever you interact with our services. This may include which webpages you visit, what you click on, when you performed those actions, and so on. We don’t use this to send you email except at the direction of an application form creator. ELIGIBILITY REQUIREMENTS AND RELEASES You must be at least 21 years of age as of March 1st, 2018. You must be a U.S. citizen or legal US resident with a valid social security or tax ID number. You must not be a candidate for public office and must agree not to become one until after one (1) year after the initial exhibition of the episodes of the Program in which you appear, if selected as a participant. Universal Television LLC (“Producer”) and NBCUniversal (as defined below) reserve the right to render ineligible any person who either of them determines, in the sole discretion of either of them, is sufficiently connected with the production, administration, judging, or distribution of the Program, such that his/her participation in the Program could create the appearance of impropriety. Producer and NBCUniversal may also consider whether you or any member of your immediate family or anyone living in your household is or has been within the last two (2) years an employee, officer, director or agent of any of the following: (i) Producer or any other person or entity involved in the development, production, distribution or other exploitation of the reality-based program currently entitled “Hollywood Game Night” (the “Program”) or any variation thereof; (ii) NBCUniversal Television Group or any station or network owned and operated by NBCUniversal Media, LLC or any of its parent, subsidiary or affiliated entities, (collectively, “NBCUniversal”); (iii) Any sponsor of the Program or its advertising agency; or Any person or entity supplying goods, services or prizes (as applicable) to the Program. If you are selected as a potential participant you must execute waivers and release agreements required by Producer and NBCUniversal or any of their licensees, successors or assigns. You will need to be available to the production March 16th – March 18th, 2018 (dates subject to change in Producer’s sole discretion) and be willing to travel to various locations as part of production. Any offer to become a participant may be conditioned upon your submission to a background check, and physical and psychological examinations to be conducted in Los Angeles, CA, by medical professionals selected by and paid for by the Producers and the certification of the medical professionals that you meet all physical and psychological requirements. If requested, you must be willing to submit medical information to the production, and you must be willing to submit to a medical examination, psychological examination, and background check. Producer reserves the right to amend or change the eligibility requirements at its sole discretion. You hereby give the following representations, warranties, acknowledgements, consents and releases: (a) By signing below, I hereby represent, warrant, acknowledge, and agree that: (i) I have read and I meet and agree to be bound by the eligibility requirements; (ii) I have completed this application honestly and accurately; (iii) if any of the information in this application is found to be false or incomplete, this will be grounds for dismissal from the Program participant selection process, and/or from the Program contest (if any), if selected; (iv) even if I meet the eligibility requirements, Producer has no obligation to further contact me, to interview me, and/or select me as a participant; (v) even if I am selected as a participant, Producer has no obligation to conduct the Program contest (if any) or produce the Program and NBCUniversal has no obligation to exhibit it, even if produced; (vi) I agree to keep strictly confidential all information about the Program that I may acquire during the participant selection process and/or during my participation in the Program (if applicable); (vii) all decisions by Producer concerning selection of the participants are final and not subject to challenge or appeal; and (viii) Producer has no obligation to return any materials submitted by me as part of the application whether or not I am selected as a participant. (b) By submitting this application, I hereby consent to the recording, use and reuse by Producer, NBCUniversal, and any of their respective licensees, successors, assignees, parents, subsidiaries, or affiliated entities, and each of their respective employees, agents, representative, officers and directors (collectively “Releasees”) of my voice, actions, likeness, name, appearance, biographical material, and any information contained in, derived from or obtained in connection with my application to be a participant in the Program or in any materials submitted by me in connection with my application (collectively “Likeness”), as edited, altered, or modified by the Producer or by any of the other Releasees, in any and all media now known or hereafter devised, worldwide in perpetuity, in or in connection with the Program or any other work. I agree that the Releasees or any of them may use all or any part of my Likeness, and may alter or modify it regardless of whether or not I am recognizable. I further agree that the Releasees exclusively own all right, title, and interest (including, without limitation, all copyrights) in and to any and all recordings made by them and in and to any and all video that I have provided in connection with my application and any other materials that I have provided or may provide in connection with my application or the Program (collectively, the “Materials”), including, without limitation, the right to edit, alter or modify the Materials and to use all or part of the Materials and my Likeness in any and all media now known or hereafter devised worldwide, in perpetuity. Without in any way limiting the foregoing, if I perform or include any music (other than music supplied to me by Producer) in connection with my application or the Program, I represent and warrant that I own all rights to such music, and I grant Producer the right to record, reproduce and publicly perform any such music in and in connection with the Program or any other work. Without in any way limiting the waivers and releases set forth herein, I waive any claims to royalties of any kind, whether accruing now or in the future, from Producer and NBCUniversal for the use of any such music, including, without limitation, any applicable copyright, public performance, mechanical and synchronization royalties. I further agree that Releasees may use my Likeness and the Materials in connection with any promotion, publicity, marketing or advertisement. I grant the rights hereunder whether or not I am selected to participate in the Program in any manner whatsoever. I understand that I will not be paid any money for giving Releasees these rights or for signing this application. (c) I hereby authorize Producer and any person or entity designated by Producer to investigate, access and collect information about me, about any of the statements made by me in my application, this Agreement, any supporting documents and any other documents that I have signed or provided or do sign or provide in connection with my application to be selected as a participant in the Program, or any other written or oral statements I make in connection therewithI irrevocably authorize Producer and any person or entity designated by Producer to secure information about me and my experiences from my current and former employers, associates, friends, family members, educational institutions, government agencies, credit reporting agencies, any branch of the military, and any references I have provided, and I irrevocably authorize such parties to provide information concerning me. I hereby unconditionally and irrevocably release and forever discharge Producer, the persons or entities designated by Producer, and all such parties and persons from any and all liabilities arising out of or in connection with any such investigation. I specifically authorize investigation of my employment records, medical records, and government records, including but not limited to my motor vehicle records, criminal records, civil records, military records, credit and consumer report(s). I acknowledge and agree that any such information obtained by Producer or by any person or entity designated by Producer pursuant to this paragraph or otherwise may be used for purposes of selecting participants in the Program or in the course of producing the Program, and may be described or otherwise related in and in connection with the Program, in and in connection with another program, and in and in connection with any advertising, promotion or publicity for the Program or other program, (d) If requested I will authorize Producer and any person or entity designated by Producer to conduct psychological and physical examinations of me as required by Producer. Further, If requested I will authorize the individuals conducting such examinations of me to disclose to Producer and their representatives all information about me obtained in connection with such examinations, and authorize Producer to utilize such information in selecting participants for the Program. (e) I understand that the participant selection process will involve subjective decisions made by certain individuals selected by Producer and/or NBCUniversal in their sole discretion. I understand that the participant selection process may also involve subjective decisions made by the public. I further understand that those certain individuals, NBCUniversal, Producer and/or other persons or entities may be acquainted with or have some familiarity with some or all of the applicants to varying degrees. I understand and agree that all participant selection and elimination decisions shall be final and binding on me in all respects, and shall not be subject to challenge or appeal. (f) I further acknowledge and agree that Producer reserves the right to consider and select participants who are not able to attend an open casting call and that Producer shall have sole discretion and control over every aspect of selecting participants, and Producer’s decisions on all matters related to selecting participants shall be final and binding and not subject to challenge or appeal. 10) RELEASE AND AGREEMENT NOT TO SUE. To the maximum extent permitted by law, I release Releasees from any and all liability arising out of my participation in or in connection with the Program, including, without limitation, the recording of my Likeness and the Materials, my participation in the participant selection process of the Program, and any exploitation of the Program, my Likeness or the Materials, on any legal theory whatsoever (including, without limitation, personal injury, rights of privacy and publicity, false light and defamation) (the “Released Claims”). Further, to the maximum extent permitted by law, I agree not to sue Releasees as a result of the recording or use of my Likeness and/or the Materials (including, without limitation, any claim that such use defames me or invades any right of privacy and/or publicity) or for any reason based on any of the Released Claims hereunder. 11) CONFIDENTIALITY. Whether or not I am selected to be a participant on the Program, I shall keep in strictest confidence and shall not disclose to any other applicant, participant or other third party at any time (i.e., prior to, during, or after the taping or exhibition of any episode of the Program) any information or materials of any kind, including without limitation, any information or materials concerning or relating to Producer or to NBCUniversal, the business of Producer or NBCUniversal, any program produced by Producer and/or exhibited by NBCUniversal, including, without limitation, any information concerning or relating to the Program, the Program applicants, the Program participants, the location(s) of the Program, the events contained in the Program, or the outcome of any episode of the Program, that I read, hear or otherwise acquire or learn in connection with or as a result of my applying to be a participant on the Program or (if I am selected to be a participant) as the result of my experiences as a participant on the Program (collectively, the “Information and Materials”). I acknowledge and agree that the Information and Materials are confidential and the exclusive property of Producer and/or NBCUniversal. At no time will I ever, directly or indirectly, divulge in any manner or use or permit others to use any of the Information and Materials. I acknowledge and agree that my obligations with respect to confidentiality set forth in this application shall continue in perpetuity or until terminated by NBCUniversal by giving me written notice of termination. In no event will I have the right to terminate my confidentiality obligations under this application. I acknowledge that in the event I breach the confidentiality or any other provisions of this application, my breach may, in the sole discretion of Producer and/or NBCUniversal result in my being disqualified to participate as a participant in the Program. I further acknowledge that a breach by me of any of the confidentiality provisions of this application would cause Producer and NBCUniversal irreparable injury and damage that cannot be reasonably or adequately compensated by damages in an action at law, and, therefore, I hereby expressly agree that Producer and NBCUniversal shall be entitled to injunctive and other equitable relief to prevent and/or cure any breach or threatened breach of any of the confidentiality provisions of this application by me. 12) As used herein, “Producer” shall include Production Company, its licensees, successors, and assigns, and each of their respective officers, directors, shareholders, employees, agents, and representatives. I agree that Producer may license, assign, and otherwise transfer this application and all rights granted by me under this application to any person or entity. 13) CHOICE OF LAW. This application shall be interpreted under the internal, substantive laws of the State of California, without regard to the conflicts of law provisions thereof. 14) MEDIATION & ARBITRATION. The parties agree that if any controversy or claim arising out of or relating to this application cannot be settled through direct discussions, they shall endeavor first to settle the controversy or claim by a mediation administered by JAMS under its applicable rules. If THE dispute is not otherwise resolved through direct discussions or mediation, the parties agree that the controversy or claim, including the scope or applicability of this agreement to arbitrate, shall THEN be resolved by FINAL AND binding confidential arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules and Procedures or subsequent versions thereof, INCLUDING ITS OPTIONAL APPEAL PROCEDURE (the “JAMS Rules”, AVAILABLE AT www.jamsadr.com, including, without limitation, the rule providing that each party shall pay pro rata its share of jams fees and expenses, and the rules providing for limited discovery and other exchange of information). The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be licensed to practice law in CALIFORNIA AND BE EXPERIENCED IN THE ENTERTAINMENT INDUSTRY. All proceedings brought pursuant to this paragraph will be conducted in the city of Los Angeles. THE PARTIES AGREE THAT THE REMEDY FOR ANY CLAIM BROUGHT PURSUANT TO THIS APPLICATION SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE OR EXEMPLARY DAMAGES OR TO RESCIND THIS APPLICATION OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. NOTWITHSTANDING THE FOREGOING, to the extent required by law, the parties agree that with respect to the arbitration of any federal or state claim I bring that arises from unwaivable public rights, whether statutory or nonstatutory, the following shall apply: the arbitrator may award any remedy that would have been available in court; the parties shall be permitted discovery adequate to secure the necessary information to present such claim or defend against such claim; and producer shall pay all types of costs that are unique to arbitration. I RECOGNIZE THAT GIVEN THE UNIQUE NATURE OF THE PROGRAM AND THE COMMERCIAL REALITIES OF THE ENTERTAINMENT INDUSTRY, WHICH RELY UPON CONFIDENTIALITY AND INTELLECTUAL PROPERTY RIGHTS, ANY ACTUAL OR ANTICIPATED BREACH OF MY CONFIDENTIALITY OBLIGATIONS PURSUANT TO THIS APPLICATION, OR ANY INFRINGEMENT BY ME OF PRODUCER’S OR NBCUNIVERSAL'S INTELLECTUAL PROPERTY RIGHTS, WOULD CAUSE PRODUCER AND NBCUNIVERSAL IRREPARABLE INJURY AND DAMAGE THAT CANNOT BE REASONABLY OR ADEQUATELY COMPENSATED BY MONEY AND, THEREFORE, I AGREE THAT PRODUCER AND NBCUNIVERSAL SHALL BE ENTITLED TO SEEK AND OBTAIN INJUNCTIVE AND OTHER EQUITABLE RELIEF FROM A COURT OF COMPETENT JURISDICTION FOR ANY SUCH BREACH OR INFRINGEMENT. 15) SEVERABILITY. The illegality, invalidity or unenforceability of any provision of this application shall in no way affect the validity or enforceability of any of the remainder of this application, which shall be enforced to the maximum extent permitted by law. I have read, understand, and agree with the foregoing. I UNDERSTAND THAT I AM GIVING UP CERTAIN LEGAL RIGHTS UNDER THIS APPLICATION, INCLUDING, WITHOUT LIMITATION, MY RIGHT TO FILE A LAWSUIT IN COURT WITH RESPECT TO ANY CLAIM ARISING IN CONNECTION WITH THIS APPLICATION.
